[COMMERCIAL WARRANTY]

Limited Lifetime Warranty

Epoxy & Sealing Systems, Inc. extends a Limited Lifetime Warranty to commercial clients, ensuring that our specially designed products for concrete surfaces resist yellowing from UV exposure throughout the lifespan of the original purchaser. These products are also guaranteed against chipping, peeling, separation, or delamination on any properly installed and prepared vertical or horizontal, interior or exterior surfaces for the lifetime of the original commercial purchaser.

This warranty covers the defect-free nature of our products under these conditions. Compensation is limited to the original cost of materials or product replacement, at the discretion of Epoxy & Sealing Systems, Inc. (excluding shipping, taxes, and tariffs). The company’s sole obligation under this warranty is restricted to providing materials necessary for rectifying the affected areas. Evaluation by a qualified company representative or certified installer is mandatory to identify the cause of any issue before undertaking repairs, ensuring prompt and effective resolution. 

WARRANTY TERMS FOR COMMERCIAL CLIENTS

This warranty remains valid at the site of original installation for commercial entities. It is voided if the installation contravenes local codes or ordinances, or if the product is utilized in a manner not intended by its original design. 

COMMERCIAL WARRANTY EXCLUSIONS

This warranty does not extend to damages arising from misuse, alterations, animal damage, accidents, fire, exposure to corrosive substances, extreme heat (exceeding 250 degrees F), smoke, iron oxide penetration, or hydrostatic water pressure.

Exclusions also encompass failures resulting from inadequate surface preparation according to Epoxy & Sealing Systems, Inc.’s guidelines. Required preparation involves removing all previous coatings, sealers, and other adhesion impediments. The surface must be ground to achieve a 50 to 100 grit profile, maintain a neutral pH of 7, and exhibit a moisture vapor transmission rate not exceeding 3 pounds. Epoxy & Sealing Systems, Inc. is not liable for determining moisture presence within the concrete substrate. The warranty’s liability is confined to the cost of replacement materials. 

PROCEDURE FOR COMMERCIAL WARRANTY CLAIMS

Commercial clients should immediately contact Epoxy & Sealing Systems, Inc. at service@epoxyss.com to initiate a warranty claim. This should include the type of material, date of purchase, and a detailed description of the issue, accompanied by photographs of the alleged damage. The company reserves the right to inspect the material and confirm warranty applicability. This warranty is limited to the cost of replacement materials for the original purchaser, with additional installation costs or product price increases being the customer’s responsibility. 

COMMERCIAL SAFETY NOTICE

All treated surfaces can become slippery, particularly when wet. Epoxy & Sealing Systems, Inc. is not responsible for injuries stemming from slips or falls on these surfaces. It is the duty of the commercial purchaser to ensure safety measures. While anti-slip additives may lower slip risks, they do not guarantee absolute slip prevention. Epoxy & Sealing Systems, Inc. therefore disclaims liability for any slip-and-fall incidents. 

SERVICES FOR PAID REPAIRS

Commercial clients facing substrate-related damages like cracks or deterioration are eligible for repair services, starting with a base fee of $250. Any damages caused by the client are also subject to repair under this service. 

ADDITIONAL TERMS

No representative is authorized to amend or extend warranties on behalf of Epoxy & Sealing Systems, Inc. beyond these stated terms. IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THIS WARRANTY’S DURATION. The company’s liability is exclusively governed by this warranty document. Claims for incidental or consequential damages (including water damage) are expressly excluded.

Legal variances by state regarding warranty limitations or the exclusion of incidental or consequential damages may apply. Commercial clients are advised to keep a printed copy of this warranty. Proof of purchase or the effective warranty date is required for claims; absent this, the date of batch manufacture will be deemed as the start of the warranty period.
